1. Acceptance of Terms

By accessing or using the Neptune mobile application, website, or any related services (collectively, the "Service") operated by Neptune Surfing LLC, DBA Neptune ("Neptune," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Neptune provides AI-powered surf coaching, real-time surf conditions, session tracking, and related features through its iOS and Apple Watch applications. The Service includes both free and paid subscription features.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account and use the Service.

4. Subscriptions and Payments

Some features of the Service require a paid subscription. Subscription terms, pricing, and billing cycles are presented at the time of purchase. By subscribing, you agree to:

  • Pay the applicable fees as described at the time of purchase
  • Automatic renewal of your subscription unless canceled before the renewal date
  • Manage and cancel subscriptions through your Apple ID account settings

All payments are processed through Apple's App Store. Refunds are subject to Apple's refund policies.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service to transmit harmful, offensive, or objectionable content
  • Resell, redistribute, or sublicense access to the Service

6. AI Coaching Disclaimer

Neptune's AI coaching features are provided for informational and educational purposes only. The AI-generated recommendations are not a substitute for professional surf instruction. You acknowledge that:

  • AI coaching suggestions may not account for all individual circumstances, skill levels, or conditions
  • Surfing is an inherently dangerous activity and you participate at your own risk
  • Neptune is not liable for any injuries, damages, or losses resulting from following AI coaching recommendations
  • You should always exercise your own judgment regarding ocean safety and conditions

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Neptune Surfing LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

8. User Content

You retain ownership of any content you submit through the Service (e.g., session notes, profile information). By submitting content, you grant Neptune a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEPTUNE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

SURF CONDITION DATA, FORECASTS, AND RECOMMENDATIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT BE ACCURATE. NEPTUNE IS NOT RESPONSIBLE FOR DECISIONS MADE BASED ON THIS INFORMATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEPTUNE SURFING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO NEPTUNE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Neptune Surfing LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Santa Barbara County, California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
